Terms and Conditions

Last updated 16 September 2026

These terms are an agreement between you and Verge Inc., a company based in California, United States (“we”, “us”). They govern the use of VergeServer — the console at https://127.0.0.1:2012, the desktop application, the mobile application, and the tool endpoints that projects call. By signing in or calling a tool with a project key, you accept them. If you do not accept them, do not use the service.

1. Who may use VergeServer

VergeServer is private. There is no public sign-up. An account exists only where an administrator created it, and it may be withdrawn by an administrator at any time. Use it only for the operator's own infrastructure and projects, or infrastructure you are authorised to administer.

2. Accounts and credentials

3. What the service does

VergeServer monitors servers, mirrors information from connected cloud accounts, and carries out actions you ask for: deploying code, restarting services, rebooting instances, reading and writing files, running database queries, opening shell sessions, transferring files, sending messages and placing calls. These actions affect live systems.

4. Your responsibility for what you run

5. Acceptable use

You must not:

6. The tools

The messaging, download and calling tools carry additional duties, which rest with the project that calls them:

We may suspend a tool, a key or a linked number where we believe these duties are not being met, or where a provider requires it.

7. Your content and your credentials

Everything you put into the console — projects, notes, tasks, documents, attachments and the data in the systems you connect — stays yours. You grant us only the permission needed to host, process and display it so the service can work for you, and to make backups. You confirm you have the rights to the content you upload. Stored credentials are held encrypted and used only to carry out what you ask; see the Privacy Policy.

8. Third-party services

The service depends on third parties, including cloud, email, messaging and error-tracking providers. Your use of a connected service is also subject to that provider's own terms, and their availability, changes or failures are outside our control.

9. Availability

We aim to keep VergeServer available, but it is provided without any guaranteed level of service. Maintenance, updates, provider incidents and faults may interrupt it, monitoring data may be delayed or incomplete, and an alert may be late or missed. Do not rely on it as the sole safeguard for a system where failure would cause serious harm.

10. No warranties

To the fullest extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. Nothing here excludes a warranty that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for lost profits, lost revenue, lost data, business interruption, or any indirect, special, incidental, punitive or consequential loss, however caused. Our total liability arising out of or in connection with the service is limited to the amount you paid for it in the twelve months before the claim, or, where nothing was paid, to a nominal sum. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

12. Indemnity

You will indemnify us against claims, losses and costs arising from your use of the service in breach of these terms or of the law — in particular claims arising from messages sent, calls placed, or systems acted upon through your account or your project key.

13. Confidentiality

The console exposes sensitive operational information. Treat what you see through it as confidential, and do not disclose it outside the people authorised to have it.

14. Suspension and termination

An administrator may suspend or delete an account at any time. We may suspend or end access where these terms are broken, where the law or a provider requires it, or where continuing would put the service or others at risk. On termination your right to use the service stops at once; content is handled as set out in the Privacy Policy, and you should export anything you need beforehand.

15. Changes

We may change the service and these terms. The date at the top shows when these terms were last revised, and a significant change will be notified to account holders by email. Continuing to use the service after a change means you accept the revised terms.

16. Governing law and disputes

These terms, and any dispute arising out of or relating to them or to the service, are governed by the laws of the State of California and the federal laws of the United States that apply there, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

You and Verge Inc. agree that the state and federal courts located in California have exclusive jurisdiction, and each of us consents to the personal jurisdiction of those courts and waives any objection that they are an inconvenient forum. Either of us may still seek injunctive relief in any court of competent jurisdiction to protect confidential information or intellectual property.

Nothing in this section removes a mandatory protection that the law of your own country gives you.
